Store Terms
Effective from April 24, 2026
§ 1. General provisions
- These Terms govern sales of goods offered through the online store available at punktologia.com (the "Store").
- The seller is Jakub Ambrożkiewicz, 25 Czerwca 60, 26-610 Radom, Poland (the "Seller").
- Contact: email kontakt@punktologia.com, phone +48 505 651 480.
- A customer may be a natural person with full legal capacity, a legal person, or an organisational unit without legal personality (the "Customer").
- A "Consumer" means a Customer who is a natural person entering into a contract for purposes not directly related to their business or professional activity, as defined in art. 22¹ of the Polish Civil Code.
§ 2. Formation of the contract
- The sales contract is concluded in English or Polish, through the Store.
- An order is placed by adding selected products to the cart, choosing a shipping method, providing the required data, and confirming the order with an obligation to pay.
- The contract is concluded upon successful payment processed by the payment operator.
- The Customer receives an order confirmation to the indicated email address.
- The Seller reserves the right to refuse order fulfilment in case of stock exhaustion or unavailability; in such cases the Seller promptly refunds any payments received.
§ 3. Prices and payments
- All prices in the Store are final prices expressed in Polish złoty (PLN). Sales are conducted as Polish unregistered activity and are VAT-exempt under art. 113(1) of the Polish VAT Act.
- The total order price consists of the price of goods and the shipping cost, both presented before the order is placed.
- Payments are processed by Stripe Payments Europe, Ltd. Available payment methods include, without limitation, payment cards (Visa, Mastercard), BLIK, Przelewy24, and other methods made available by the operator.
- The Seller does not store payment card data — the entire payment process takes place on the operator's side.
- A personalised receipt is generated automatically once the order is paid and sent to the Customer as a PDF by email.
§ 4. Shipping
- Shipping is available within the territory of the Republic of Poland only.
- Available shipping methods and their costs:
- InPost Paczkomaty — 12.99 PLN (estimated delivery: 2-3 business days)
- Order processing time (preparation for shipment) is up to 5 business days from payment confirmation. Carrier delivery time should be added to this.
- If a shipment is not delivered within the estimated time, please contact us at kontakt@punktologia.com.
§ 5. Right of withdrawal (Consumers only)
- A Consumer who has concluded a distance contract has the right to withdraw from it without giving any reason within 14 days of taking possession of the goods.
- To exercise the right of withdrawal, the Consumer must inform the Seller by an unequivocal statement — in writing or by email to kontakt@punktologia.com. The Consumer may use the sample withdrawal form attached to these Terms (§ 10), but is not required to do so.
- In case of withdrawal, the contract is deemed not concluded. The Consumer shall return the goods to the Seller without undue delay, no later than 14 days after the day on which they communicated the withdrawal, to: Jakub Ambrożkiewicz, 25 Czerwca 60, 26-610 Radom.
- The Consumer bears the direct cost of returning the goods.
- The Seller will reimburse all payments received from the Consumer, including the cost of delivery (excluding supplementary costs resulting from a delivery type other than the cheapest standard delivery offered by the Seller), without undue delay and no later than 14 days from the day on which the withdrawal notice is received. The reimbursement will be made using the same means of payment used by the Consumer, unless the Consumer has expressly agreed otherwise.
- The Seller may withhold reimbursement until the goods have been received back, or until the Consumer has supplied evidence of having sent them back, whichever is earlier.
- The Consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
§ 6. Complaints (non-conformity of goods)
- The Seller is liable to the Consumer for non-conformity of the goods with the contract under the rules set out in the Polish Consumer Rights Act of 30 May 2014.
- Complaints may be submitted by email to kontakt@punktologia.com or in writing to the Seller's address. Please include: full name, order number, description of the defect, and preferred remedy (repair, replacement, price reduction, or withdrawal under statutory rules).
- The Seller will respond to the complaint within 14 days of its receipt.
- Shipping costs of the complained goods are borne by the Seller if the complaint is justified.
- For Customers who are not Consumers, statutory warranty is excluded to the extent permitted by law.
§ 7. Personal data
- The controller of Customers' personal data is the Seller: Jakub Ambrożkiewicz, 25 Czerwca 60, 26-610 Radom.
- Personal data is processed for the purpose of concluding and performing the sales contract, issuing a proof of purchase, handling complaints, and fulfilling legal obligations (including tax obligations).
- The legal basis for processing is: art. 6(1)(b) GDPR (contract performance), art. 6(1)(c) GDPR (legal obligation).
- Recipients of the data may include: the payment operator (Stripe), carriers (InPost), the hosting provider, and the email service provider.
- Data is stored for the period necessary to perform the contract and for the period required by law (in particular tax law — 5 years from the end of the accounting year).
- Customers have the right to access their data, rectify it, erase it, restrict processing, data portability, and the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, Poland).
- Providing data is voluntary but necessary to conclude and perform the contract.
- Detailed information on data processing (recipients, retention periods, transfers outside the EEA, cookies) can be found in the Privacy Policy.
§ 8. Out-of-court complaint handling and dispute resolution
- Consumers may use out-of-court means of complaint handling and pursuing claims, including:
- mediation conducted by Voivodeship Inspectorates of Trade Inspection,
- permanent consumer arbitration courts,
- assistance of a district (municipal) consumer ombudsman.
- Consumers may also use the EU Online Dispute Resolution (ODR) platform provided by the European Commission: https://ec.europa.eu/consumers/odr.
§ 9. Final provisions
- Matters not regulated by these Terms are governed by the generally applicable provisions of Polish law, in particular the Civil Code and the Consumer Rights Act.
- The Seller reserves the right to amend these Terms for important reasons (e.g. changes in law, changes in payment or shipping methods). Amendments do not affect rights already acquired by Customers. Orders placed before the amendments take effect will be processed under the previous Terms.
- These Terms are effective from April 24, 2026.
